IMPORTANT NOTICE:

By downloading, installing, or using Shelly ("the App"), developed by Vlad Stefanescu ("the Developer") at GreenCoders.net ("the Company"), you ("the User") explicitly agree to comply with and be bound by all terms and conditions stated within this Agreement. If you disagree with any term, you are prohibited from downloading, installing, or using the App.

LICENSE GRANT AND RESTRICTIONS

Grant of License:

The Developer hereby grants the User a limited, non-exclusive, non-transferable, revocable license to download, install, and use Shelly and its source code strictly for:
• Personal use
• Educational purposes
• Internal, non-commercial purposes only

Explicit Restrictions:

The User is explicitly prohibited from engaging in the following activities:

• Selling, reselling, renting, leasing, sublicensing, or commercially exploiting the App or any portion of its source code.
• Redistributing or distributing the App or any portion of its source code in original or modified form, regardless of whether it's for commercial or non-commercial purposes.
• Creating derivative works based on the App or its source code for redistribution or commercial exploitation.

Violation of any of these restrictions immediately terminates your license and may result in legal action, including but not limited to claims for damages, injunctions, or other available remedies.

ATTRIBUTION REQUIREMENT

If the User references, demonstrates, or otherwise utilizes the App or its source code under the permitted personal, educational, or internal non-commercial purposes, explicit attribution is mandatory. Attribution must be clear, visible, and appear prominently as follows:

• "Shelly, developed by Vlad Stefanescu at GreenCoders.net"

Failure to provide proper attribution constitutes a breach of this Agreement and immediately terminates the User's right to use the App or its source code.

LIABILITY LIMITATION & DISCLAIMER

Important: Shelly is currently in a Beta (testing) phase. The App utilizes Artificial Intelligence (AI) technologies, interacting directly with your computer, performing function calls, and executing PowerShell scripts. Due to the nature and unpredictability of AI-driven software interactions, there exists the risk that using Shelly may unintentionally result in:

• File corruptions or data loss.
• Unintended or unwanted modifications to your Windows system settings.
• Incorrect, unexpected, or inappropriate system responses.
• Hardware or software malfunctions or interruptions.

These events may result from factors such as unclear, incorrect, or ambiguous prompts supplied by the User, as well as inherent issues or bugs within the App itself, which might remain undiscovered during ongoing testing phases.

By installing and using Shelly, the User explicitly acknowledges and agrees to the following terms:

• The User assumes complete and sole responsibility for all potential risks, including but not limited to loss of data, system stability, functionality, and any other type of harm or damage resulting from using Shelly.
• Neither Vlad Stefanescu (the Developer), GreenCoders.net (the Company), nor any third-party contributors, developers, or affiliates associated with the App’s creation shall be liable for any direct, indirect, incidental, consequential, exemplary, special, punitive, or other damages arising from or related to the use or misuse of Shelly, regardless of the legal theory under which such damages might be sought.

Acceptance of these terms and limitations is mandatory to use or access the App.

PRIVACY POLICY

The Developer and Company take user privacy seriously. Shelly is designed with privacy in mind and explicitly adheres to the following:
• No Personal Data Collection:
Shelly does not intentionally collect, store, or transmit any personal or identifiable user information outside the User's device.
• Local Data Handling:
The App might temporarily create usage logs or other operational data stored locally on your computer solely to facilitate and improve your interactions with the App. This data remains strictly local and under the User’s control, and is neither accessed nor retrieved externally by the Developer or Company.
• No Sharing of Data:
The Developer and Company explicitly confirm they do not and will never sell, share, or distribute user information or locally generated data to any third parties.

Your privacy remains fully protected at all times when using Shelly.

TERMS OF ACCEPTANCE

By explicitly selecting "I Agree" (via checkbox, button-click, or similar electronic consent mechanism), the User declares the following:

• The User has thoroughly read, understood, and accepted all terms and conditions outlined in this Agreement.
• The User agrees to be legally bound by these terms, including all restrictions, attribution requirements, liability limitations, disclaimers, and the privacy policy provisions herein.
• The User explicitly acknowledges the Beta status of the App and understands all associated risks and limitations.

If the User does not agree to any term presented in this Agreement, the User must immediately cease the installation, download, and/or usage of Shelly.
